Terms and Conditions – SMS

These Terms and Conditions (“Terms”) govern your use of Formidable Asset Management LLC’s (“Formidable Asset Management”, “we”, “us”, “our”) website and SMS messaging services. By using our services, you agree to these Terms, including our compliance obligations under U.S. SMS carrier regulations.

  1. Use of Our Services

By interacting with Formidable Asset Management services, including receiving SMS communications, you agree to:

  • Provide accurate and truthful contact information
  • Only use our services for lawful purposes
  • Not engage in prohibited behavior such as spamming, fraud, or harassment
  1. SMS Communication and 10DLC Compliance

2.1 Overview

Formidable Asset Management uses 10DLC (10-digit long code) SMS messaging to communicate with users and clients, which is subject to approval by U.S. mobile carriers through The Campaign Registry (TCR). All messaging traffic sent by Formidable Asset Management complies with 10DLC standards, including brand and campaign registration requirements.

2.2 Brand Registration

As a registered sender, Formidable Asset Management has submitted the following information to The Campaign Registry for carrier approval:

  • Legal business name and contact details
  • EIN (Employer Identification Number)
  • Industry and use case (e.g., customer service, appointment reminders, system alerts, marketing)

This information is used to verify our legitimacy as a message sender and is required by mobile carriers.

2.3 Campaign Use Cases

All SMS campaigns sent by Formidable Asset Management must be registered under a supported use case. Common use cases may include:

  • Customer Care (e.g., support ticket updates)
  • Notifications & Alerts (e.g., appointment reminders, system updates)
  • Two-Factor Authentication (2FA)
  • Marketing & Promotions (where opted in)

Each campaign undergoes a review and approval process and must clearly disclose the purpose and message types delivered.

2.4 Message Content Compliance

Formidable Asset Management adheres to CTIA and carrier guidelines prohibiting the following types of content:

  • SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco/Vape)
  • Deceptive or misleading content
  • Unverified URLs or domains
  • Fraudulent, abusive, or harassing messages

All messages must be clear, accurate, and consistent with the approved campaign description.

2.5 Consent and Opt-In Requirements

To receive SMS messages from Formidable Asset Management, you must provide express prior written consent, which may be collected via:

  • Web form checkboxes
  • SMS keyword opt-ins
  • Verbal or in-person agreement (documented)

We maintain opt-in records in accordance with CTIA and TCPA regulations.

2.6 Opt-Out and Help Instructions

You may opt out of SMS messages from Formidable Asset Management at any time by replying:

  • STOP – to unsubscribe from further messages
  • HELP – to receive additional support information

Once you opt out, no further SMS will be sent unless you re-consent.

2.7 Message and Data Rates

Message and data rates may apply depending on your mobile carrier and service plan. Formidable Asset Management is not responsible for these charges.

2.8 Unregistered or Unauthorized Use

Sending SMS messages through Formidable Asset Management’ platform without a registered campaign or outside of a registered use case is strictly prohibited. This includes:

  • Unapproved message content
  • Messages sent to contacts without documented consent
  • Use of Formidable Asset Management systems to bypass carrier regulations

Such violations may result in immediate suspension of services and legal action.

  1. Privacy and Data Handling

We protect your information as described in our Privacy Policy. Data used for 10DLC compliance—including opt-in records and campaign message logs—is stored securely and retained as required for audit purposes.

  1. Modification of Terms

We reserve the right to modify these Terms at any time. The revised Terms will be posted here with a new effective date. Continued use of Formidable Asset Management services after changes are posted constitutes acceptance of the new Terms.
